KY Regulatory Statutes for Continuing Education for Licensed Professional Counselors

RELATES TO: KRS 13B, 194A.540, 210.366, 335.500-335.599
NECESSITY, FUNCTION, AND CONFORMITY: KRS 210.366 requires a board licensee to complete a minimum of six (6) hours of continuing education in suicide assessment, treatment, and management every six (6) years. KRS 335.515(3), (6), and 335.535(8) require the board to promulgate an administrative regulation requiring a licensee to complete continuing education requirements as a condition of renewal of his licensee. This administrative regulation delineates the requirements for continuing education and prescribes methods and standards for the accreditation of continuing education courses.

Section 1.1
A minimum of ten (10) continuing education hours shall be accrued by each person holding a license during the annual period for renewal.

Section 1.2
All continuing education hours shall be in or related to the field of professional counseling.

Section 1.3
A person holding a license shall complete a minimum of three (3) hours of continuing education in domestic violence within three (3) years of initial licensure, as required by KRS 194A.540.

Section 1.4
A person holding a license shall complete a minimum of six (6) hours of continuing education in a course in suicide assessment, treatment, and management within the first year of licensure and every six (6) years thereafter as required by KRS 210.366.
(a) A person holding a license shall be exempt from the requirement to complete a continuing education course in suicide assessment, treatment, and management within the first year of licensure if the counselor:1. Graduated from a Council for Accreditation of Counseling and Related Education Program since 2009; or2. Completed a three (3) semester hours graduate course in suicide and crisis assessment, prevention, and intervention.
(b) A person holding a license shall be exempt from the requirement to complete a continuing education course in suicide assessment, treatment, and management if the counselor satisfies one (1) of the following at least once per year during the six (6) year periodic requirement:1. Is employed in a position that requires at least forty (40) hours of counseling in suicide and crisis assessment, prevention, and intervention;2. Teaches a graduate-level counseling course in suicide and crisis assessment, prevention, and intervention; or3. Teaches a continuing education course in suicide and crisis assessment, prevention, and intervention.
(c) The continuing education course in suicide assessment, treatment, and management shall be board approved in accordance with Section 2 of this administrative regulation.
(d) An individual asserting an exemption of the suicide assessment, treatment, and management course shall maintain sufficient documentation to establish the exemption. Documentation listed in Section 5(3) of this administrative regulation shall be sufficient to establish the exemption.

Section 1.5
A person holding a license shall complete a minimum of three (3) hours of continuing education on the law for regulating professional counseling, KRS 335.500 to 335.599 and 201 KAR Chapter 36, every three (3) years. A person holding a license shall be exempt from this requirement if the person:
(a) Teaches a graduate-level course that includes KRS 335.500 to 335.599 and 201 KAR Chapter 36 during the three (3) year period; or
(b) Teaches a continuing education course on KRS 335.500 to 335.599 and 201 KAR Chapter 36 during the three (3) year period.

Continuing education hours applicable to the renewal of the license shall be directly related to the professional growth and development of the licensee’s practice of professional counseling. They may be earned by completing any of the educational activities as established in this section.

Section 2.1
Programs not requiring board review and approval.
(a) A continuing education program from any of the following providers shall be approved without further review by the board if it is:1. Sponsored or approved by:a. The American Counseling Association, or any of its affiliated branches or divisions;b. The Kentucky Counseling Association, or any of its affiliated chapters or divisions;c. The American School Counselor Association or any of its affiliated state chapters;d. The National Board for Certified Counselors; ore. A state counseling licensure board; or2. An academic course offered by an accredited post-secondary institution directly related to professional counseling or counseling psychology.
(b) A continuing education program not requiring board review and approval shall comply with the requirements of subsection (3) of this section and Section 4 of this administrative regulation.

Section 2.2
Programs requiring board review and approval. For approval purposes, the board shall review the following types of programs to determine relevancy:
(a) A program, approved by the board, of a service provider, including a home study course or in-service training provided by another organization or educational institution;
(b) A program or academic course presented by the licensee. A presenter of relevant programs or academic courses may earn full continuing education credit for each contact hour of instruction, except the earned credit shall not exceed one-half (1/2) of the continuing education renewal requirements. Credit shall not be issued for repeated instruction of the same course; or
(c) An article authored by the licensee that was published in a relevant, professionally recognized or juried publication. Credit shall not be granted for an article unless it was published within the one (1) year period immediately preceding the renewal date and a licensee shall not earn more than one-half (1/2) of the continuing education hours required for renewal. More than one (1) publication shall not be counted during a renewal period.

Section 2.3
(a) Supervision training under 201 KAR 36:065, Section 1(3), shall be presented by an instructor who is licensed by the board.
(b) The continuing education program on the law for regulating professional counseling, KRS 335.500 to 335.599 and 201 KAR Chapter 36, shall be presented by an instructor who is licensed by the board or an attorney who demonstrates knowledge of KRS 335.500 to 335.599 and 201 KAR Chapter 36 in the Continuing Education Program Application.

Section 2.4
Academic credit equivalency for continuing education hours shall be fifteen (15) continuing education hours for every one (1) academic credit hour.

Section 2.5
A general education course, whether elective or used to meet degree requirements, shall not be acceptable as continuing education credit.

In order to submit the course to the board for approval, the following shall be submitted:

Section 3.1
A published course or similar description;

Section 3.2
Names and qualifications of the instructors;

Section 3.3
A copy of the program agenda indicating hours of education, coffee, and lunch breaks. The agenda shall state the specific time when each topic of the program is being presented;

Section 3.4
Number of continuing education hours requested;

Section 3.5
Official certificate of completion or college transcript from the sponsoring agency or college;

Section 3.6
The Continuing Education Program Application; and

Section 3.7
If a provider is seeking approval for a continuing education course, an application review fee of twenty (20) dollars.

Section 4.1
Sponsor approval. Any entity seeking to obtain approval:
(a) Of a continuing education program prior to its offering shall apply to the board at least sixty (60) days in advance of the commencement of the program, and shall provide the information required in Section 3 of this administrative regulation on an annual basis for each program; or
(b) As a prior-authorized continuing education provider under Section 2(1) of this administrative regulation, shall satisfy the board that the entity seeking this status:1. Consistently offers programs that meet or exceed all the requirements set forth in Section 1(2) of this administrative regulation; and2. Does not exclude a licensee from its programs.

Section 4.2
A continuing education activity shall be qualified for approval if the board determines the activity being presented:
(a) Is an organized program of learning;
(b) Pertains to subject matters, which integrally relate to the practice of professional counseling;
(c) Contributes to the professional competency of the licensee; and
(d) Is conducted by individuals who have educational training or experience acceptable to the board.

Section 5.1
During the licensure renewal period, up to fifteen (15) percent of all licensees shall be selected at random by the board and required to furnish documentation of the completion of the appropriate number of continuing education hours. Verification of continuing education hours shall not otherwise be reported to the board.

Section 5.2
A licensee shall:
(a) Be responsible for obtaining required continuing education hours;
(b) Identify his own continuing education needs and seek activities that meet those needs;
(c) Seek ways to integrate new knowledge, skills, and attitudes;
(d) 1. Select approved activities by which to earn continuing education hours; or2. Submit to the board a request for approval for continuing education activities not approved as required in Section 2(2) of this administrative regulation;
(e) At the time of renewal, list the continuing education hours obtained during that licensure renewal period;
(f) Document attendance, participation in, and successful completion of continuing education activity for a period of one (1) year from the date of the renewal; and
(g) Maintain records of continuing education hours.

Section 5.3
The following items may be used to document continuing education activity:
(a) Transcript
(b) Certificate
(c) Affidavit signed by the instructor; or
(d) Receipt for the fee paid to the sponsor.

Section 5.4
Compliance with the provisions of this administrative regulation. Failure to comply shall constitute a violation of KRS 335.540(1)(b) and shall result in sanctions in accordance with KRS 335.540(1).

Section 5.5
Documentation sent to the board prior to renewal shall be returned to the licensee by regular mail.

Section 6.1
A provider of continuing education not requiring board approval shall be responsible for providing documentation, as established in Section 5(3) of this administrative regulation, directly to the licensee.

Section 6.2
A sponsor of continuing education requiring board approval shall be responsible for submitting a course offering to the board for review and approval before listing or advertising that offering as approved by the board.

Section 7.1
If an application for approval of continuing education hours is denied, in whole or part, the continuing education course provider or licensee shall have the right to appeal the board’s decision.

Section 7.2
An appeal shall be:
(a) In writing
(b) Received by the board within thirty (30) days after the date of the decision denying approval of continuing education hours; and
(c) Conducted in accordance with KRS Chapter 13B.

Section 8.1
On application, the board may grant a waiver of the continuing education requirements or an extension of time within which to fulfill the requirements in the following cases:
(a) Medical disability of the licensee
(b) Illness of the licensee or an immediate family member; and
(c) Death or serious injury of an immediate family member.

Section 8.2
A written request for waiver or extension of time involving medical disability or illness shall be:
(a) Submitted by the person holding a license; and
(b) Accompanied by a verifying document signed by a licensed physician.

Section 8.3
A waiver of or extension of time within which to fulfill the minimum continuing education requirements shall not exceed one (1) year.

Section 8.4
If the medical disability or illness upon which a waiver or extension has been granted continues beyond the period of the waiver or extension, the person holding a license shall reapply for the waiver or extension.

Section 9.1
(a) Except as provided by paragraph (b) of this subsection, a person requesting reinstatement or reactivation of a license shall submit evidence of ten (10) hours of continuing education completed within one (1) year of the filing of reinstatement or reactivation.
(b) Upon request by the applicant, the board may permit the applicant to resume practice if ten (10) hours of continuing education is obtained within ninety (90) days of the date on which the applicant is approved to resume practice.

Section 9.2
The continuing education hours received in compliance with this section shall be in addition to the continuing education requirements established in Section 1 of this administrative regulation and shall not be used to comply with the requirements of that section.

Hours required to satisfy the continuing education requirement shall be completed on or before the renewal date established in 201 KAR 36:075,

Section 10.1
Failure to complete the continuing education requirement in Section 1 of this administrative regulation by the renewal date of a license shall require the applicant to submit a reinstatement application in accordance with 201 KAR 36:075.

KY Regulatory Statutes for Continuing Education for Licensed Social Workers

NECESSITY, FUNCTION, AND CONFORMITY:KRS 335.070(3) authorizes the board to promulgate administrative regulations pursuant to KRS Chapter 13A to carry out the provisions of KRS 335.010 to 335.160 and KRS 335.990. KRS 335.070(6) and KRS 335.130(4) allow the board to require continuing education as a condition of license renewal. This administrative regulation describes the requirements for continuing education for renewal and prescribes methods and standards for the board to approve continuing education courses.

Section 1.1
Academic course offered by an accredited postsecondary institution” means a graduate level social work course:
(a) Designated by a social work title or content; or
(b) A graduate level academic course relevant to social work.

Section 1.2
“Approved” means recognized by the Kentucky Board of Social Work.

Section 1.3
“Continuing education hour” means fifty (50) clock minutes of participation in continuing education programs.

Section 1.4
“Program” means an organized educational experience, which is:
(a) Planned and evaluated to meet behavioral objectives; and
(b) Presented in one (1) session or series.

Section 1.5
“Provider” means a person or an organization approved by the Kentucky Board of Social Work to provide a single continuing education program over the course of one (1) year.

Section 1.6
“Relevant” means having content applicable to the practice of social work.

Section 1.7
“Sponsor” means a person or an organization approved by the Kentucky Board of Social Work to provide more than one (1) continuing education program over the course of one (1) year.

Section 1.8
“Training program in suicide assessment, treatment, and management” means an empirically supported training program approved by the board that is at least six (6) hours in length and contains suicide assessment including screening and referral, suicide treatment, and suicide management as required by KRS 210.366.

Accrual and Computation of Continuing Education Hours for Renewal.

Section 2.1
Each certified social worker and licensed clinical social worker shall complete a minimum of thirty (30) continuing education hours during the three (3) year period for renewal, which shall be completed in person before a live presenter or through home or self-study, courses delivered through electronic media or technology including distance learning, online, or teleconference courses.

Section 2.2
Each licensed social worker shall complete a minimum of fifteen (15) continuing education hours during the three (3) year period for renewal, which shall be completed in person before a live presenter or through home or self-study, courses delivered through electronic media or technology including distance learning, online, or teleconference courses.

Section 2.3
All continuing education hours shall be relevant to the licensee’s level of licensure.

Section 2.4
Kentucky Code of Ethical Conduct. Each renewal period, as part of the required continuing education hours, each licensee shall complete a board approved three (3) hour course on the Kentucky Code of Ethical Conduct established in 201 KAR 23:080, which shall be taken in person before a live presenter or through courses delivered through electronic media or technology including distance learning, online, or teleconference courses.

Section 2.5
Clinical Social Work Supervision. Each renewal period, as part of the required continuing education hours, each licensed clinical social worker who is a board approved supervisor pursuant to 201 KAR 23:070, Section 4(1)(c)2., shall complete a three (3) hour, board approved clinical social work supervision course, which shall be taken in person before a live presenter.
(6)Training Program in Suicide Assessment, Treatment, and Management. Every six (6) years, as part of the required continuing education hours, each licensee shall complete a minimum of six (6) hours of continuing education in a board approved training program in suicide assessment, treatment, and management as required by KRS 210.366(2).
(a) The training program in suicide assessment, treatment, and management shall be approved by the board, by a pre-approved provider or sponsor identified in Section 3(1) of this administrative regulation, or by one (1) of the following boards:

  1. Kentucky Board of Licensure of Marriage and Family Therapists;
  2. Kentucky Board of Licensed Professional Counselors;
  3. Kentucky Board of Licensure for Pastoral Counselors;
  4. Kentucky Board of Alcohol and Drug Counselors;
  5. Kentucky Board of Examiners of Psychology; or
  6. Kentucky Board of Licensure for Occupational Therapy.

(b) Exemptions. A licensee shall be exempted from completion of the training program in suicide assessment, treatment, and management if he or she:

  1. Teaches or taught a graduate-level counseling course in suicide assessment, treatment, and management at least once during the six (6) year period; or
  2. Teaches or taught a six (6) hour continuing education course in suicide assessment, treatment, and management at least once during the six (6) year period.

Section 2.7
Domestic Violence and Elder Abuse, Neglect, and Exploitation. During the three (3) year renewal period following initial licensure, as part of the required continuing education hours, each licensee shall complete a three (3) hour course in domestic violence, and elder abuse, neglect, and exploitation as defined by KRS 194A.540.

Section 2.8 Pediatric Abusive Head Trauma. At least one (1) time every six (6) years, as part of the required continuing education hours, each licensee shall complete one and one-half (1.5) hours of continuing education covering the recognition and prevention of pediatric abusive head trauma as defined in KRS 620.020.

Section 2.9
Academic Credit Equivalency. Academic credit equivalency for continuing education hours shall be based on one (1) credit hour equals fifteen (15) continuing education hours.

Continuing education hours for renewal shall be directly related to the professional growth and development of the licensee. The hours may be earned by completing any of the continuing education programs listed in this section.

Section 3.1
Preapproved programs not requiring board review and approval. Except for courses on the Kentucky Code of Ethical Conduct under Section 2(4) of this administrative regulation, and courses on clinical social work supervision under 201 KAR 23:070, Section 4(1)(c)2., which require separate review and approval by the board, an educational program from any of the following providers shall be deemed to be relevant to the practice of social work and shall be approved without further review by the board if it is:
(a) Sponsored or approved by:

  1. The Association of Social Work Boards (ASWB);
  2. The National Association of Social Workers (NASW) or any of its affiliated state chapters;
  3. The National Association of Black Social Workers (NABSW) or any of its affiliated state chapters;
  4. The North American Association of Christians in Social Work or any of its affiliated state chapters; or
  5. The Clinical Social Work Association or any of its affiliated state chapters;

(b)Sponsored by:

  1. The American Psychological Association or any of its affiliated state chapters;
  2. The American Counseling Association or any of its affiliated state chapters;
  3. The National Board for Certified Counselors or any of its affiliated state chapters;
  4. The American Psychiatric Association or any of its affiliated state chapters; or
  5. A college, school, department, or program of social work in Kentucky, which is accredited by the Council on Social Work Education (CSWE); or

(c) An academic course offered by an accredited postsecondary institution directly related to social work, counseling, or psychology.

Section 3.2
Programs requiring board review and approval.
(a) A program that is not provided or sponsored by a preapproved provider or sponsor identified in subsection (1) of this section shall be reviewed by the board and approved for continuing education credit if the board determines that it is:

  1. Relevant to the practice of social work; and
  2. Contributes to the continuing professional competency of licensees.

(b) The board may approve various methods in which a continuing education program is presented including:

  1. Home or self-study, courses delivered through electronic media or technology including distance learning, online, or teleconference courses; and
  2. In-service training, conferences, or workshops provided by other organizations, educational institutions, or other service providers approved by the board.

(c) Board approval for home or self-study courses, courses delivered through electronic media or technology including distance learning, online, or teleconference courses shall be obtained each year unless the continuing education program does not require board approval under subsection (1) of this section.

Section 3.3
Relevant programs or academic courses presented by the licensee. A licensee who presents relevant programs or academic courses shall earn full continuing education credit for each contact hour of instruction, not to exceed one-half (1/2) of the continuing education renewal requirements. Credit shall not be issued for repeated instruction of the same course.

Section 3.4
Relevant articles authored by the licensee. A licensee who is an author of a relevant article, which is published in a professionally recognized or juried publication, shall earn seven and a half (71/2) hours of the continuing education requirements for renewal if a certified social worker or fifteen (15) hours of the continuing education requirements for renewal if a licensed social worker or licensed clinical social worker, if the article was published within one (1) year immediately preceding his or her renewal date.

Section 3.5
The following continuing education courses shall be submitted to the board for approval and shall not be automatically preapproved under subsection (1) of this section:
(a) Kentucky Code of Ethical Conduct required by Section 2(4) of this administrative regulation; and
(b) Clinical social work supervision for board-approved supervisors required by 201 KAR 23:070, Section 4(1)(c)2.

Section 4.1
Provider Approval. A provider seeking approval of a continuing education program shall apply to the board no less than thirty (30) days in advance of the commencement of the program, and provide the information required by subsection (3) of this section.

Section 4.2
The board shall approve a continuing education program if it determines that the program being presented:
(a) Is relevant to the practice of social work;
(b) Contributes to the continuing professional competency of a licensee; and
(c) Has competent instructors with appropriate academic training, professional license or certification, or professionally recognized experience.

Section 4.3
The board may approve a provider of a continuing education program for one (1) year if the provider:
(a) Files a completed Provider or Sponsor Application for Continuing Education Approval, which includes:

  1. A published program outline that includes an explanation of the program objectives;
  2. The names and qualifications of the instructors presented in the form of resumes or curriculum vitas;
  3. A copy of the evaluation sheet by which the licensee can assess and comment on the program;
  4. A copy of the program agenda stating the number of continuing education credit hours, including all breaks;
  5. The number of continuing education credit hours requested;
  6. A copy of the official certificate of completion or attendance from the provider; and
  7. A statement whether the provider is requesting approval to meet the requirements of the following courses:
    a.Kentucky Code of Ethical Conduct required by Section 2(4) of this administrative regulation; or
    b.Clinical social work supervision for board-approved supervisors required by 201 KAR 23:070, Section 4(1)(c)2.; and

(b) Pays an application fee, payable to the Kentucky State Treasurer, of:

  1. $100 for each one (1) day program of eight (8) hours or less; and
  2. $100 for each additional one (1) day program of eight (8) hours or less.

Section 4.4
If the provider is requesting approval to meet the requirements of the Kentucky Code of Ethical Conduct course required for renewal by Section 2(4) of this administrative regulation, a minimum of one (1) presenter or instructor for the course shall:
(a) Hold a degree in social work;
(b) Hold an active license to practice social work in the Commonwealth of Kentucky;
(c) Not have an unresolved, pending disciplinary action before the board; and
(d) Not be practicing social work under terms or conditions of supervision imposed by the board.

Section 4.5 If the provider is requesting approval to meet the requirements of the clinical social work supervision course required for board approved supervisors by 201 KAR 23:070, Section 4(1)(c)2., each presenter and instructor for the course shall:
(a) Hold a degree in social work;
(b) Hold an active social work license in the Commonwealth of Kentucky;
(c) Be a board approved supervisor;
(d) Not have an unresolved, pending disciplinary action before the board; and
(e) Not be practicing social work under terms or conditions of supervision imposed by the board.

Section 4.6 A provider of continuing education shall be responsible for providing documentation in the form of a certificate of attendance or completion directly to the licensee, as established in Section 7(5) of this administrative regulation.

Section 4.7
A provider of a continuing education program requiring board approval shall not advertise that a course has been approved before written board approval has been received.

Section 4.8 Provider Renewal. An approved provider shall submit a Provider or Sponsor Renewal Application for Continuing Education Approval for a subsequent one (1) year period by:
(a) Notifying the board that the original information required in this section for each program remains current; and
(b) Paying a renewal fee, payable to the Kentucky State Treasurer, of:

  1. Fifty (50) dollars for each one (1) day program of eight (8) hours or less; and
  2. $100 for each additional one (1) day program of eight (8) hours or less.

Section 5.1
Sponsor Approval. A sponsor seeking approval of continuing education programs shall apply to the board no less than thirty (30) days in advance of the commencement of the program, and provide the information required by subsection (3) of this section.

Section 5.2
The board shall approve a continuing education program if it determines that the program being presented meets the following criteria:
(a) Is relevant to the practice of social work;
(b) Contributes to the professional competency of the licensee; and
(c) Has competent instructors with appropriate academic training, professional licenses or certifications, or professionally recognized experience.

Section 5.3
The board may approve a sponsor of continuing education programs for one (1) year if the sponsor:
(a) Files a completed Provider or Sponsor Application for Continuing Education Approval, which includes:

  1. A published program outline that includes an explanation of the program objectives;
  2. The names and qualifications of each presenter and instructor documented in the form of resumes or curriculum vitas;
  3. A copy of the evaluation sheet by which the licensee can assess and comment on the program;
  4. A copy of the program agenda stating the number of continuing education credit hours, including all breaks;
  5. The number of continuing education credit hours requested;
  6. A copy of the official certificate of completion from the sponsor; and
  7. A statement whether the sponsor is requesting approval to meet the requirements of the following courses:
    a.Kentucky Code of Ethical Conduct required by Section 2(4) of this administrative regulation; or
    b.Clinical social work supervision for board-approved supervisors required by 201 KAR 23:070, Section 4(1)(c)2.; and

(b) Pays an initial application fee of $250 made payable to the Kentucky State Treasurer.

Section 5.4
If the sponsor is requesting approval to meet the requirements of the Kentucky Code of Ethical conduct course required for renewal by Section 2(4) of this administrative regulation, a minimum of one (1) presenter or instructor for the course shall:
(a) Hold a degree in social work;
(b) Hold an active license to practice social work in the Commonwealth of Kentucky;
(c) Not have an unresolved, pending disciplinary action before the board; and
(d) Not be practicing social work under terms or conditions of supervision imposed by the board.

Section 5.5 If the sponsor is requesting approval to meet the requirements of the clinical social work supervision course required for board approved supervisors by 201 KAR 23:070, Section 4(1)(c)2., each presenter or instructor for the course shall:

(a) Hold a degree in social work;
(b) Hold an active social work license in the Commonwealth or Kentucky;
(c) Be a board approved supervisor;
(d) Not have an unresolved, pending disciplinary action before the board; and
(e) Not be practicing social work under terms or conditions of supervision imposed by the board.

Section 5.6
The board shall periodically review the programs that a sponsor has provided to determine if the sponsor continues to meet the requirements of this administrative regulation.
Section 5.7
An approved sponsor shall submit an annual report to the board of the continuing education programs offered during that calendar year and shall include copies of attendance sheets and evaluations (or evaluation summaries) for each program.
Section 5.8
A sponsor of a continuing education program shall be responsible for providing documentation in the form of a certificate of attendance directly to the licensee, as established in Section 7(5) of this administrative regulation.
Section 5.9
A sponsor of a continuing education program requiring board approval shall not advertise that the course has been approved before written board approval has been received.
Section 5.10
Sponsor Renewal. An approved sponsor shall submit a Provider or Sponsor Renewal Application for Continuing Education Approval for a subsequent one (1) year period by notifying the board that the original information required in this section for each program remains current and by paying $150 renewal fee made payable to the Kentucky State Treasurer.

Section 6.1
A licensee may request an individual review of a continuing education program that was otherwise not approved if it was completed during the three (3) year renewal period if the individual licensee:
(a) Applies for individual review by submitting the Individual Application for Continuing Education Approval that includes the:

  1. Certificate of completion or attendance;
  2. Resume of each instructor; and
  3. Program agenda indicating hours of instruction; and

(b) Pays a fee of ten (10) dollars made payable to the Kentucky State Treasurer.

Section 6.2
The board’s review shall be based on the standards for continuing education established by this administrative regulation.

Section 6.3
The board’s approval of a continuing education program under this section shall:
(a) Qualify as if it has been obtained from an approved provider or sponsor; and
(b) Be limited to the particular program upon which the request for individual review is based.

Each licensee shall be responsible for obtaining the required continuing education hours for her or his renewal. The licensee shall identify his or her own continuing education needs, seek continuing professional education activities to meet those needs, and develop ways to integrate new knowledge, skills, and attitudes. Each licensee shall:

Section 7.1
Select approved programs by which to earn continuing education hours for renewal;

Section 7.2
Submit to the board, if applicable, a request for continuing education programs requiring approval by the board as established in Section 3of this administrative regulation;

Section 7.3
Maintain her or his records of continuing education hours;

Section 7.4
At the time of renewal, list the continuing education hours obtained during that licensure renewal period; and

Section 7.5
If requested by the board, furnish documentation of continuing education courses completed at the time of his or her renewal.
(a) In each calendar year, the board shall require up to fifteen (15) percent of all licensees to furnish documentation of the completion of continuing education hours for the current renewal period;
(b) Documentation of continuing education hours shall not otherwise be reported to the board;
(c) Documentation shall take the form of official documents including:

  1. Transcripts;
  2. Certificates of completion or attendance;
  3. Affidavits signed by instructors; or
  4. Receipts for fees paid to the provider or sponsor; and

(d) Each licensee shall retain copies of his or her documentation for a period of one (1) year following the date of his or her last renewal.

If an application for approval of continuing education hours is denied, in whole or part, a licensee, provider, or sponsor may request the board to reconsider its decision. The request shall be in writing and shall be received by the board within thirty (30) days after the date of the board’s decision denying approval of continuing education hours.

Section 9.1
In individual cases involving medical disability, illness, or undue hardship as determined by the board, the board may grant waivers of the minimum continuing education requirements or extensions of time to fulfill the requirements for renewal or make the required reports of continuing education credits.

Section 9.2
A licensee may submit a written request to the board for a waiver or extension of time involving medical disability, illness, or undue hardship.
(a) If the request is based on medical disability or illness, the licensee shall include a written statement signed by a licensed physician.
(b) If the request is based upon undue hardship, the licensee shall submit a written explanation of the nature of the undue hardship.
(c) The board may request that a licensee provide additional information and verification by a third party.

Section 9.3
The board may grant a waiver of the minimum continuing education requirements or an extension of time to a licensee to fulfill the continuing education requirements for renewal for a period of time not to exceed one (1) calendar year.

Section 9.4
If the medical disability, illness, or undue hardship upon which a waiver or extension has been granted continues beyond the period of the waiver or extension, the licensee may reapply for the waiver or extension.
(a) If the reapplication is based on medical disability or illness, the licensee shall include a written statement signed by a licensed physician.
(b) If the reapplication is based upon undue hardship, the licensee shall submit a written explanation of the nature of the undue hardship.
(c) The board may request that a licensee provide additional information and verification by a third party to support the reapplication.

Section 10.1
A certified social worker or a licensed clinical social worker who requests reinstatement of an expired license shall submit documentation of completion of thirty (30) hours of continuing education within the three (3) year period immediately preceding the date he or she submits the request for reinstatement to the board.

Section 10.2
A licensed social worker who requests reinstatement of an expired license shall submit documentation of completing fifteen (15) hours of continuing education within the three (3) year period immediately preceding the date he or she submits the request for reinstatement to the board.

Section 10.3
If the licensee requesting reinstatement cannot provide evidence of completion of the required hours of continuing education, the board may reinstate the license for six (6) months on the condition that the licensee obtain the required hours of continuing education for his or her level of licensure within six (6) months of the date the license is reinstated.
(a) The continuing education hours completed for reinstatement shall be in addition to the continuing education requirements for renewal established in Section 2 of this administrative regulation and shall not be used to comply with the requirements of that section.
(b) Failure to obtain the required continuing education hours within the approved six (6) month period shall result in termination of the reinstated license.

Section 11.1

KY Regulatory Statutes for Continuing Education for Marriage and Family Therapists

201 KAR 32:060, Section 3 states, “(3) An approved continuing education sponsor is a person or organization which is approved by the board to provide more than one (1) continuing education program over a two (2) consecutive calendar year period of time.” You can find the continuing education Sponsors, that are approved by the board during their monthly meetings, inside the current year’s list below. 201 KAR 32:060, Section 1 states, “(1) A minimum of fifteen (15) approved continuing education hours shall be accrued by each licensee and a minimum of ten (10) approved continuing education hours shall be accrued by each associate during each one (1) year renewal period.”

“(2) All hours shall be in “the practice of marriage and family therapy” as defined by KRS 335.300(4) and shall relate to the professional application of psychotherapeutic and systems theories and techniques in the delivery of services to individuals, couples, and families.”

“(3) Three (3) hours of the hours required by subsection (1) of this section for licensees and associates shall be accrued in the field of professional marriage and family therapy ethics.”

Kentucky Targeted Case Management Trainings and Certification Requirements

RELATES TO: KRS 200.503(3), 210.005(2), (3)
NECESSITY, FUNCTION AND CONFORMITY: KRS 194A.050(1) requires the secretary of the Cabinet for Health and Family Services to promulgate administrative regulations necessary to protect the health of Kentucky citizens and to implement programs mandated by federal law or to qualify for the receipt of federal funds. KRS 210.450 requires the secretary to promulgate administrative regulations governing qualifications of personnel and standards for personnel management for community programs for behavioral health or individuals with an intellectual disability. KRS 222.211 authorizes the cabinet to promulgate administrative regulations to assure that there is the provision of prevention, intervention, and treatment services for both juveniles and adults to address the problems of addiction to alcohol and other drug abuse within individuals, families, and communities. This administrative regulation establishes the minimum eligibility and training requirements for individuals providing behavioral health targeted case management services to a targeted behavioral health population.

Section 1.1
Behavioral health practitioner under supervision” means an individual who is:

(a)
1. A licensed professional counselor associate;
2. A licensed assistant behavior analyst;
3. A certified social worker;
4. A marriage and family therapy associate;
5. A licensed professional art therapist associate;
6. A physician assistant; or
7. A certified alcohol and drug counselor; and

(b) Employed by or under contract with the same billing provider as the billing supervisor.

Section 1.2
“Behavioral health professional” means:

(a) An advanced practice registered nurse as defined by KRS 314.011(7);
(b) A licensed clinical social worker as defined by KRS 335.100;
(c) A licensed marriage and family therapist as defined by KRS 335.300(2);
(d) A licensed professional clinical counselor as defined by KRS 335.500(3);
(e) A licensed psychological practitioner as defined by KRS 319.053;
(f) A licensed psychologist as defined by KRS 319.010(6) and 201 KAR Chapter 26;
(g) A licensed professional art therapist as defined by KRS 309.130(2);
(h) A physician as defined by KRS 205.510(11);
(i) A psychiatrist;
(j) A behavioral health practitioner under supervision;
(k) A registered nurse as defined by KRS 314.011(5) working under the supervision of a physician or advanced practice registered nurse;
(l) A certified alcohol drug counselor as defined by KRS 309.083;
(m) A certified psychologist as defined by 201 KAR Chapter 26;
(n) A certified psychologist with autonomous functioning as defined by KRS 319.056;
(o) A certified social worker as defined by KRS 335.080
(p) A licensed professional art therapist associate as defined by KRS 309.130(3);
(q) A licensed psychological associate as defined by KRS 319.010(6) and 201 KAR Chapter 26;
(r) A marriage and family therapy associate as defined by KRS 335.300(3);
(s) A physician assistant as defined by KRS 311.840(3);
(t) A licensed clinical alcohol and drug counselor as defined by KRS 309.080(4);
(u) A licensed clinical alcohol and drug counselor associate as defined by KRS 309.080(5); or
(v) An individual with a bachelor’s degree in a behavioral science as defined in subsection

(3) of this section who:
1. Is working under the supervision of a billing supervisor; and
2. Has at least five (5) years of documented full-time experience providing specialized case management services for the target population.

Section 1.3
“Behavioral science” means:

(a) Psychology;
(b) Sociology;
(c) Social work;
(d) Family studies;
(e) Human services;
(f) Counseling;
(g) Nursing;
(h) Behavioral analysis;
(i) Public health;
(j) Special education;
(k) Gerontology;
(l) Recreational therapy;
(m) Education;
(n) Occupational therapy;
(o) Physical therapy;
(p) Speech-language pathology;
(q) Rehabilitation counseling; or
(r) Faith-based education.

Section 1.4
“Case load” means the number of distinct individuals for whom a targeted case manager bills for services from any payor, per month.

Section 1.5
“Certification” means successful completion of the training requirements in this administrative regulation as documented by notice of successful training completion submitted to the department from the training provider.

Section 1.6
“Chronic or complex physical health condition” means that:

(a) Significant symptoms of a physical health condition have persisted in a client for a continuous period of at least six (6) months;

(b) The symptoms of the physical health condition significantly impair the client’s ability to function:
1. Socially, or
2. Occupationally which, for individuals under the age of twenty-one (21), includes impairment in an educational setting; and

(c)
The physical health conditions include disorders under the following categories:
1. Cardiovascular disorders;
2. Respiratory disorders;
3. Genitourinary disorders;
4. Endocrine disorders;
5. Musculoskeletal disorders;
6. Neurological disorders;
7. Immune system disorders;
8. Gastrointestinal;
9. Cancer; or
10. Hematological.

Section 1.7
“Client” means an individual identified within a target population.

Section 1.8
“Continuing education requirement” means successful completion of the on-going training requirements every three (3) years after the date of certification.

Section 1.9 “Core components” means the minimum knowledge and skills listed in Section 3(1) of this administrative regulation that an individual must demonstrate in order to successfully complete the training and meet eligibility requirements to provide targeted case management services.

Section 1.10
“Department” means the Department for Behavioral Health, Developmental and Intellectual Disabilities (DBHDID).

Section 1.11
“Face-to-face” means in person, in the same location, and not through an electronic method.

Section 1.12
“Serious mental illness”, “severe mental illness”, or “SMI” means a diagnosis of a major mental disorder as included in the current edition of the Diagnostic and Statistical Manual of Mental Disorders under:
(a) Schizophrenia spectrum and other psychotic disorders;
(b) Bipolar and related disorders;
(c) Depressive disorders; or
(d) Post-traumatic stress disorders (under trauma and stress or related disorders).

Section 1.13
“Severe emotional disability” or “SED” is defined by KRS 200.503(3).

Section 1.14
“Substance use disorder” or “SUD” means a primary moderate or severe substance use disorder diagnosis or co-occurring moderate to severe substance use disorder and mental health diagnosis as defined in the current edition of the Diagnostic and Statistical Manual of Mental Disorders.

Section 1.15
“Targeted case management services” means services furnished to assist a client in gaining access to needed medical, social, educational, or other needed services and supports, including:

(a) Assessment of the client’s medical, social, and functional status and identification of the client’s strengths and needs;
(b) Arranging for service delivery from the client’s, the client’s legal guardian, or the client’s custodial parent’s chosen provider to insure access to required services;
(c) Facilitating access to needed services by explaining the need and importance of services in relation to the client’s condition;
(d) Facilitating access, quality, and delivery of necessary services; and
(e) Preparation and maintenance of case record documentation to include care plans, forms, reports, and narratives as appropriate.

Section 1.16
“Targeted case manager” means an individual who is:

(a) Trained and supervised to perform targeted case management services in accordance with Section 2 of this administrative regulation;
(b) Responsible for conducting a comprehensive assessment and a periodic reassessment of an individual’s strengths and needs; and
(c) Responsible for assisting an individual to gain access to identified medical, social, educational, and other service needs.

Section 1.17

(a) SMI;
(b) SED;
(c) SUD; or
(d) SMI, SED, or SUD and a co-occurring chronic or complex physical health condition.

Section 1.18
“Training curriculum” means a total package of learning activities designed to achieve the goals of the training program with:

(a) The objective that trainees will acquire the specific knowledge and skills (competencies) needed to perform the duties of a targeted case manager; and
(b)
Four (4) primary components, including:

1. Content or information to be transmitted, including:
a. Theoretical framework;
b. Conceptual rationale;
c. Best standards of practice;
d. Application to direct practice; and
e. Congruence between and within sections;

2. Organization of the curriculum, including structure, format, and sequencing, incorporating:
a. Concordance with the natural learning process;
b. Design of each section linked to specific learning objectives, with adequate time provided for each;
c. Linkages between sections;
d. Knowledge and skills that are conceptually related, or that are performed together on the job, are taught together; and
e. Retention and understanding facilitated by principles of sequencing (from simple to complex, from the universal to the exception, and from fundamental to more refined applications) and repetition;

3. Training methods appropriate to adult learners in an applied setting, in each section or topic area, including:
a. Discussion to promote exploration and understanding of the topic;
b. Experiential exercises or simulations; and
c. Presentation of the same concepts using a variety of learning strategies (for example, hearing, seeing, modeling, and then practicing) to ensure that trainees with different learning styles can assimilate the knowledge; and

4. Evaluation methods, including:
a. Trainee knowledge assessment through testing, with achievement of a passing aggregate assessment score of at least seventy (70) percent; and
b. Trainee performance reviews of trainers.

Section 2.1
A targeted case manager for individuals with SMI, SED, or SUD shall:

(a)
1. Possess a bachelor of arts or science degree in a behavioral science;
2. Be a certified alcohol and drug counselor who has a bachelor of arts or science degree;
3. Have provided targeted case management services to a recipient any time from April 1, 2014, to the effective date of this administrative regulation; or
4. Have supervised the provision of targeted case management services to a recipient any time from April 1, 2014, to the effective date of this administrative regulation;

(b)
Have at least one (1) year of full-time employment experience after completing the educational requirements:
1. Working directly with adults in a human service setting; or
2. Working directly with individuals under the age of twenty-one (21) in a human service setting;
(c) Successfully complete a department approved targeted case management training within six (6) months of employment as a targeted case manager; and
(d) Successfully complete department approved continuing education requirements every three (3) years thereafter.

Section 2.2 A master’s degree in a behavioral science may substitute for the one (1) year of full-time employment experience required by subsection (3)(b)1 of this section.

Section 2.3
A targeted case manager for individuals with SMI, SED, or SUD and a co-occurring chronic or complex physical health condition shall be an individual with:
(a) A master’s degree in a behavioral science from an accredited college or university and two (2) years of full-time employment experience providing service coordination or linking/referring for community based services for individuals with SMI, SED, or SUD and co-occurring physical or behavioral health disorders or multi-agency involvement; or
(b) A bachelor of arts or science degree from an accredited college or university in a behavioral science and who has:
1. At least five (5) years of full-time employment experience working with an individual with SMI, SED, or SUD and a co-occurring chronic or complex physical health condition;
2. Successful completion of a department approved targeted case management training within six (6) months of employment as a case manager; and
3. Successful completion of continuing education requirements every three (3) years thereafter.

Section 2.4
Targeted case managers who are serving individuals with SED, SMI, or SUD shall have:
(a) Individual face-to-face supervision which shall be provided at least monthly for at least one (1) year by a behavioral health professional who has completed the targeted case management training approved by the department; and
(b) Group supervision which shall be provided at least monthly for the duration of employment as a targeted case manager.

Section 2.5
The supervisor of a targeted case manager shall maintain documentation of the supervision.

Section 2.6
Targeted case managers who are serving an individual with an SED, SMI, or SUD and a co-occurring chronic or complex physical health condition shall have:
(a) Individual supervision which shall be provided at least three (3) times per month, with at least two (2) of these supervisory contacts on an individual face-to-face basis, for at least three (3) years by a behavioral health professional who has completed the targeted case management training approved by the department; and
(b) Group supervision which shall be provided at least monthly for the duration of employment as a targeted case manager.

Section 2.7
Beginning October 1, 2015, a targeted case manager shall not exceed a case load size of twenty-five (25) unique clients receiving any service, excluding a client receiving mobile crisis services, crisis intervention services, or screenings.

Section 2.8
A targeted case manager shall:
(a) Only provide targeted case management services to the targeted population for which the targeted case manager meets the educational, experiential, and training requirements; and
(b) Not provide other behavioral health services in addition to targeted case management services for the same client.

Section 3.1 To receive certification to provide behavioral health targeted case management services, a targeted case manager shall successfully complete the department approved training and continuing education requirements established by this section. (a) The core components of the targeted case management training curriculum shall be at least twelve (12) hours and shall include: 1. Core targeted case management functions and guiding principles; 2. Engaging consumers and family members; 3. Behavioral health crisis management; 4. Strengths-based case management; 5. Ethics; 6. Behavioral health diagnosis and understanding treatment; 7. Integrated care; 8. Advocacy skills and empowering consumers and families; 9. Cultural awareness; 10. Developmental perspectives across the life span; and 11. Documentation and billing. (b) At least an additional six (6) hours of specialized training for the target population the targeted case manager is serving, which shall include the skills required to address the specific needs of each respective target population. (c) Providers of approved training curricula shall notify the department within twenty (20) business days of a trainee’s successful completion of a targeted case manager training. Section 3.2 A targeted case manager shall complete continuing education requirements every three (3) years. Section 3.3 Required continuing education shall consist of acquiring at least six (6) hours of relevant continuing education each year in training topics directly related to: (a) Case management; (b) Behavioral health; or (c) Each respective target population. Section 3.4 A targeted case manager shall submit a list of all continuing education trainings in which the targeted case manager participated, the provider or presenter of the training, and the number of hours of each training to the Department every three (3) years through the department’s Web site. The submission due date shall be the last day of the month of which the targeted case manager’s initial certification was completed. Section 3.5 Targeted case managers certified prior to the effective date of this administrative regulation shall submit documentation of continuing education hours prior to May 2018.

Section 4.1
Within twenty (20) business days, approve or deny training curricula submitted by providers wishing to provide training to a targeted case manager or a prospective targeted case manager based on the training curriculum requirements established by Section 3(1)(a) of this administrative regulation;

Section 4.2
Maintain a record of approved targeted case management training curricula, including contact information for providers of the trainings on the department’s Web site;

Section 4.3
Maintain a record of targeted case managers who have received a certificate of successful completion of a department approved targeted case management training on the department’s Web site;

Section 4.4
Create and make available a process for recording continuing education of targeted case managers on the department’s Web site; and

Section 4.5
Maintain a record of targeted case managers who have been certified or completed continuing education to provide targeted case management services on the department’s Web site.

Section 5.1 A targeted case manager shall provide services under the supervision of a behavioral health professional in accordance with 907 KAR 15:040, 907 KAR 15:050, and 907 KAR 15:060; Section 5.2 The supervising behavioral health professional shall complete the training requirements as described in Section 3(1) and (2) of this administrative regulation; and Section 5.3 The supervisor of a targeted case manager shall provide and maintain documentation of the supervision, as specified in Section 2(4), (5), and (6) of this administrative regulation.
